Important simulation notice

All Trade3ra trading is simulated using historical market data. No live orders are placed, and no customer trading capital is deposited or traded.

Important facts you must understand before purchasing

  1. 1All trading is simulated. Trade3ra does not place your orders on any exchange, broker, dealer, liquidity provider, or live market. You do not deposit trading capital, own an asset, or receive a brokerage account.
  2. 2The market sequence comes from historical data. Trade3ra uses real historical market-data sequences and keeps the asset or symbol visible, but may conceal the original date, day, year, historical-data identity, and exact price scale to protect challenge integrity. Trade3ra does not create or change candles after seeing your trading decisions.
  3. 3Displayed prices are reference values. A session may begin at a randomly assigned displayed price between 1,000 and 5,000. That number is not the instrument's historical quote, present market price, or cash value.
  4. 4Account balances and profits are virtual. A SIM account size, balance, profit, loss, drawdown, and buying power are mathematical simulation values only and are not customer funds.
  5. 5Fees buy digital access, not an investment. Your payment purchases a limited license to use Trade3ra's software and, where selected, participate in a rules-based skill assessment. It is not a deposit, stake in a fund, security, commodity interest, or promise of income.
  6. 6Payouts are conditional performance rewards. A qualifying SIM Performance user may request a cash reward from Trade3ra under the public rules. A payout is not profit generated by a live trade, is not guaranteed, and remains subject to objective rule verification, identity checks, fraud review, payment availability, and applicable law.
  7. 7Simulated results do not predict live results. Actual trading can differ materially because real orders face liquidity, slippage, latency, queue position, spread, fees, market impact, emotional pressure, and financial risk that a simulation cannot fully reproduce.

By selecting the required unchecked boxes and activating the clearly labeled purchase button, you confirm that you read, understood, and agreed to this Agreement and the Product Rule Summary shown for the specific purchase.

1. Parties, scope, and electronic acceptance

1.1 Parties. This Customer Services Agreement (the Agreement) is between Trade3ra L.L.C., a company organized in the Republic of Kosovo (Trade3ra, we, us, or our), and the individual customer accepting it (you or Trader).

1.2 Covered services. This Agreement governs the Trade3ra website, applications, Replay tools, free access, subscriptions, SIM Combine accounts, SIM Performance accounts, certificates, journals, support, and related digital services (collectively, the Services).

1.3 Contract documents. The Agreement includes: (a) this master text; (b) the versioned Product Rule Summary presented immediately before payment; (c) the public Rule Center version identified in that summary; (d) the Privacy Policy; and (e) any promotion-specific written terms shown before purchase. They form one contract for that purchase.

1.4 Priority. Account-specific commercial values in the accepted Product Rule Summary control over general descriptions elsewhere. This Agreement controls general legal and conduct terms. A later advertisement, social-media post, FAQ, or rules update does not retroactively change an active account.

1.5 Electronic consent. You agree that checking the required boxes and selecting a purchase button that clearly states the price and payment obligation is your electronic signature. Trade3ra will record the accepted versions and send or make available a durable copy capable of being saved and reproduced.

1.6 Corrections before purchase. Before paying, you must be able to review your selected product, price, currency, renewal status, account values, and contact information, and correct input errors. After purchase, Trade3ra will provide an electronic confirmation without undue delay.

1.7 Mandatory rights. Nothing in this Agreement excludes any consumer, privacy, payment, or other right that applicable law does not permit you to waive.

2. Eligibility and customer representations

  • You are at least 18 years old and have legal capacity to contract in your location.
  • You use the Services only for yourself and not for an undisclosed principal, client, employer, or third party.
  • The identity, address, country, tax, payment, and verification information you provide is accurate and current.
  • Your access and receipt of any payout are lawful in your location, and you are not located in or ordinarily resident in a jurisdiction Trade3ra blocks.
  • You are not a person or entity with whom Trade3ra or its payment partners are prohibited from dealing under applicable sanctions or trade restrictions.
  • You understand that skill, discipline, and rule compliance do not guarantee that you will pass or receive a payout.

Trade3ra may decline a purchase, prevent access, or withhold a transaction when reasonably necessary to comply with law, sanctions, payment-partner requirements, age limits, location restrictions, or documented fraud controls. Any paid but undelivered service will be refunded where required by this Agreement or law.

3. What Trade3ra provides

3.1 Replay

Replay is a practice environment for reviewing and trading market sequences from historical data. Depending on the selected mode or plan, a user may select a historical session or receive a randomly assigned session. Random mode may conceal the original date and other identifying data. Replay is educational practice software; it does not offer payout eligibility unless a specific purchase expressly says otherwise.

Free Replay access may provide up to two sessions during a rolling or stated 24-hour period, after which free access may pause until the displayed reset time. Paid Replay features, price, billing cycle, session availability, instruments, and cancellation terms are shown before subscription.

3.2 SIM Combine

SIM Combine is a paid, rules-based evaluation conducted entirely in the simulation. Its purpose is to challenge a trader's execution, consistency, and risk control on concealed or transformed historical market sequences. Passing may qualify the trader for a same-size SIM Performance account after automated and, where needed, manual verification. Passing does not provide live capital or employment.

3.3 SIM Performance

SIM Performance remains entirely simulated. It allows an eligible trader to continue demonstrating performance under public rules and, when every payout condition is met, submit a request for a cash performance reward. The displayed SIM balance is not segregated money and cannot be withdrawn except through an approved payout request calculated under Section 8.

3.4 No regulated trading service or advice

Trade3ra does not, through these Services, open brokerage accounts, accept customer margin, execute or clear trades, custody investment assets, manage customer money, recommend transactions, provide individualized investment advice, or promise a live proprietary-trading relationship. Trade3ra is not representing that it is a broker, futures commission merchant, introducing broker, commodity trading advisor, commodity pool operator, exchange, investment adviser, bank, or payment institution. A regulator may determine legal classification based on actual operations, regardless of labels used here.

4. Historical market data, concealment, and chart transformations

4.1 Historical source. The underlying candle sequence is derived from historical market data. It is not a forecast and it is not a live feed. A historical source may contain vendor errors, gaps, corrections, timing differences, roll adjustments, or incomplete volume and liquidity information.

4.2 Visible symbol. Trade3ra keeps the asset or symbol name visible and does not hide, substitute, or relabel it. Trade3ra may conceal the original calendar date, day, year, exact historical price scale, contract month, and other clues to the assigned historical segment. Time-of-day remains visible. In Replay, date visibility may depend on known-date or random mode.

4.3 Random displayed price. For challenge integrity, the displayed reference price may be normalized so that a session begins at a randomly assigned value from 1,000 through 5,000 across supported assets. The displayed number is not the source instrument's historical quote. Relative candle structure is derived through the platform's documented transformation logic.

4.4 Pre-session transformations. Before a session is assigned, Trade3ra may apply a consistent offset, scale, normalization, segmentation, or, where enabled, directional inversion. The asset or symbol is not relabeled. These measures help prevent recognition of the original historical segment. Every transformation is determined before the trader acts and cannot change in response to entries, exits, direction, profit, loss, or payout status.

4.5 No targeted chart manipulation. Trade3ra will not fabricate candles, alter an assigned price path after observing the trader, widen an individual user's simulated spread to cause a failure, or selectively change rule calculations to avoid a payout. Corrections for a documented data or software error must follow Section 11 and be auditable.

4.6 Windows and timeframes. Each session uses one five-day historical data range. The trader may progress up to three days forward within that same range. At the three-day forward limit or the end of the range, the platform resets to a new session. Trade3ra may offer Asia, London, and New York sessions and timeframes up to four hours.

4.7 Simulated fills. Orders and fills are determined only by the simulation engine and the disclosed settings. A fill may differ from live trading and may be affected by candle granularity, gaps, order type, spread and commission settings, and the order in which the engine resolves prices within a candle. Platform logs control unless the user proves a manifest system error.

SIMULATED RESULTS ARE HYPOTHETICAL. NO LIVE TRADES ARE EXECUTED. SIMULATED RESULTS MAY DIFFER MATERIALLY FROM REAL TRADING AND DO NOT PREDICT FUTURE RESULTS.

5. Accounts, security, records, and account limits

5.1 One customer profile. Unless Trade3ra gives written permission, one individual may maintain only one verified customer profile. All accounts must belong to and be controlled by that individual.

5.2 Active-account limit. A customer may hold no more than 50 active SIM accounts at one time, unless a lower limit is displayed for the product or required by law or a payment partner. Breached, completed, expired, or suspended accounts do not count as active unless the Product Rule Summary states otherwise.

5.3 Credentials. You must safeguard your password, authentication methods, and devices; notify Trade3ra promptly of suspected unauthorized access; and not permit anyone else to view hidden data or trade your account.

5.4 Dashboard visibility and retention. A breached or closed account may be removed from active customer views. Removal from the dashboard is not deletion. Trade3ra may retain purchase, consent, identity, trading, payout, fraud, tax, complaint, and audit records for the period reasonably required by law, legitimate dispute prevention, payment rules, and the Privacy Policy.

5.5 Verification. Trade3ra may require identity, age, address, location, payment ownership, tax, and sanctions verification before activation, transfer, or payout. Information requests must be proportionate to the stated purpose and handled under the Privacy Policy.

6. Product Rule Summary and rule versioning

Immediately before payment, Trade3ra will show a readable Product Rule Summary containing every material value for the selected account. The accepted snapshot becomes part of this Agreement and will remain available in the customer's records.

No unpublished rule may be used to fail an account or reject a payout. Security methods may remain confidential, but the conduct they prohibit and the consequence applied must be reasonably described in the public rules.

7. SIM Combine rules

7.1 Profit target and 40% consistency

To pass, the account must reach the base profit target shown at checkout and satisfy the 40% trade-consistency rule. At the time of pass review:

Largest positive closed Trade divided by total net simulated profit must be 40% or less. Equivalently, required total net profit is the greater of the base target or Largest Winning Trade / 0.40.

Example: if the base target is $3,000 and the largest winning Trade is $2,000, the trader must continue until total net simulated profit is at least $5,000. Exceeding 40% does not automatically breach or restrict the account; it postpones qualification until the ratio is satisfied.

7.2 Maximum loss per Trade

The maximum permitted loss on one Trade is 50% of that account's maximum drawdown. A Trade includes all orders that form one continuous net position or substantially related exposure; splitting an order does not create multiple loss allowances.

When the simulated loss on a Trade reaches the limit, the engine must close the Trade automatically at the first simulated executable price available under the engine's rules. The account remains active after that automatic close unless its total maximum-loss threshold is also breached or another published rule is violated. Market gaps or candle granularity may cause the recorded close to occur slightly beyond the exact threshold.

7.3 Trailing maximum-loss limit

Unless the Product Rule Summary expressly states a different method, the maximum-loss threshold follows the highest realized account balance dollar for dollar until the threshold reaches the original starting balance. It never moves downward and stops trailing after reaching the starting balance.

Illustrative trailing-loss example

For a $25,000 SIM account with a $1,000 maximum drawdown: the threshold starts at $24,000. If the highest realized balance reaches $25,500, it moves to $24,500. When the highest realized balance reaches $26,000, it reaches $25,000 and remains there.

The trailing calculation is based on realized closed balance. The accepted Product Rule Summary states whether the total-loss breach test also uses intraday equity or unrealized losses.

7.4 No day-based qualification requirement

SIM Combine has no minimum number of trading days. Qualification is based on Trades and the published account metrics, not on calendar days. The account does not fail merely because a fixed number of sessions has elapsed, and the former 12-session limit does not apply. Technical abuse-prevention rate limits are not trading-day qualifications.

7.5 Passing and transfer

When the account reaches its applicable target, satisfies consistency, remains above the maximum-loss threshold, and has no unresolved rule review, trading stops for pass verification. On approval, Trade3ra issues a SIM Combine completion certificate and provides the same-size SIM Performance account identified by the accepted product terms. Any activation charge must have been clearly shown before the original purchase or separately accepted before payment.

7.6 Breach and reset

If the total maximum-loss threshold is breached, the SIM Combine is closed and removed from active trading views. Trade3ra may offer a paid reset, including a promotional 10% discount or an occasional complimentary administrative reset, but a reset is not guaranteed unless included in the Product Rule Summary. The reset terms and price must be accepted before charge. Practice access may be offered as an alternative.

8. SIM Performance and payout rules

8.1 Performance remains simulated

A SIM Performance account is not a funded brokerage or live proprietary account. All balances and Trades remain simulated historical-market results. A cash payout is a contractual performance reward paid by Trade3ra from its general corporate funds after the request is approved; it is not a withdrawal of customer property or live trading profit.

8.2 Account-specific buffer

The buffer for each SIM Performance account equals that account's maximum drawdown unless a more favorable amount is shown at checkout. The trader must first build the simulated account from the starting balance to Starting Balance + Buffer. The buffer is not withdrawable.

8.3 30% payout consistency

For the first payout, the measurement period begins at SIM Performance activation. After an approved payout, a new measurement period begins with the next Trade, unless the accepted Product Rule Summary states another method. At request review:

Largest positive closed Trade in the payout measurement period divided by total net simulated profit for that period must be 30% or less. Exceeding 30% does not by itself breach or restrict the account; the trader may continue until the ratio qualifies.

8.4 Loss limits

The same 50%-of-maximum-drawdown loss limit per Trade, automatic close behavior, total trailing maximum-loss rule, and anti-circumvention treatment in Section 7 apply to SIM Performance unless the accepted Product Rule Summary is more favorable to the trader.

8.5 Maximum payout request

When the balance is above Starting Balance + Buffer and all other rules are satisfied, the maximum gross request is:

Gross Request Limit = 50% of simulated profit above Starting Balance + Buffer. It is also subject to any account-specific payout cap shown before purchase.

Trade3ra's split is 90/10: the trader receives 90% of the approved gross request and Trade3ra retains 10%. Unless the Product Rule Summary clearly states another method, the SIM balance is reduced by the full approved gross request, including both portions.

Illustrative payout example

Starting balance $25,000; maximum drawdown and buffer $1,000; current balance $27,000. Profit above the $26,000 buffer level is $1,000. Maximum gross request is $500. At a 90/10 split, the trader receives $450, Trade3ra retains $50, and the SIM balance is reduced by $500.

8.6 Request availability and review

An eligible trader may submit a payout request whenever the dashboard permits, including on a daily-request model. The ability to request on a given day is not a promise of same-day review, payment, or bank receipt. Estimated processing times, payout methods, processor charges, currency conversion, and any minimum or maximum amount must be disclosed in the payout interface.

Trade3ra may verify only: the public quantitative rules; account identity and ownership; payment and tax information; prohibited conduct; sanctions or location restrictions; duplicate requests; chargebacks or amounts legally owed; and documented data or software errors. Trade3ra may not deny an otherwise valid payout merely because the amount is inconvenient or the trader was successful.

8.7 Approval, rejection, and appeal

  1. 1The dashboard records the request amount, measurement period, rule metrics, and rule version.
  2. 2Trade3ra may place a temporary review hold and request reasonably necessary information. It will identify the category of concern without revealing security methods that would enable evasion.
  3. 3An approval states the approved gross amount, trader share, Trade3ra share, balance adjustment, payment method, and status.
  4. 4A rejection states the rule or evidence category relied on and, unless prohibited by law or security needs, gives the trader an opportunity to respond or appeal within 14 calendar days.
  5. 5After successful payment, Trade3ra issues a payout certificate showing the trader's verified display name, SIM account size, payout amount actually paid to the trader, approval or payment date, certificate ID, and authorized Trade3ra signature.

8.8 Certificates and taxes

A certificate confirms only the stated simulated milestone or processed reward. It is not a license, professional credential, audited investment-performance record, proof of live trading, or promise of future payouts. The trader is responsible for taxes, reporting, and professional advice in the trader's jurisdiction. Trade3ra may require tax forms before payment.

9. Prohibited conduct and challenge integrity

The following conduct is prohibited because it defeats the skill assessment, threatens the platform, or creates legal or payment risk:

  • Account sharing or third-party control. Allowing another person, bot operator, signal seller, account manager, or coordinated group to access or trade the account.
  • Multiple or false identities. Creating duplicate profiles, using another person's identity or payment method, falsifying location or KYC documents, or evading an account restriction.
  • Historical-data matching. Using external data, leaked mappings, coordinated searches, pattern-matching databases, or future knowledge to identify the concealed historical date, session segment, or later price path.
  • Reverse engineering and extraction. Scraping, bulk downloading, decoding transformation seeds, bypassing access controls, redistributing market data, or attempting to discover confidential anti-cheat logic.
  • Exploiting errors. Knowingly using stale or impossible prices, latency, duplicate fills, cancellation errors, bracket errors, reset defects, calculation bugs, or another technical malfunction to create simulated profit or payout eligibility.
  • Coordinated or offsetting abuse. Mirroring or copying across unrelated users, using simultaneous opposite positions across accounts to guarantee a winning account, or dividing substantially one position to evade a per-Trade rule.
  • Unauthorized automation. Using scripts, APIs, macros, high-frequency order generation, or automated strategies unless the Product Rule Summary expressly permits the specific method.
  • Payment, referral, or promotion abuse. Fraudulent chargebacks, bonus cycling, self-referrals, stolen payment instruments, or manipulation of affiliate or discount programs.
  • Platform or legal harm. Malware, denial-of-service activity, unauthorized access, intellectual-property infringement, unlawful content, threats, or harassment.

Normal discretionary trading, losing Trades, profitable Trades, a large but rule-compliant Trade, or use of an A++ setup is not prohibited merely because it creates payout eligibility.

10. Fair enforcement

10.1 Evidence and proportionality. Trade3ra will use account logs, consent records, data-assignment records, device and access information, payment records, and other reasonably reliable evidence. A remedy should be proportionate to the violation and may include correcting an affected Trade, recalculating metrics, warning, temporary review hold, suspension, breach, payout rejection, or termination.

10.2 Immediate action. Trade3ra may act without advance notice when reasonably necessary to prevent active security harm, fraud, unlawful payment, data leakage, sanctions exposure, or continued exploitation. It will provide post-action notice when legally and operationally possible.

10.3 No secret adverse rules. An account may not be failed and a payout may not be rejected using an unpublished trading strategy restriction. Confidential detection methods may be withheld, but the underlying prohibited behavior and available consequence must appear in the accepted rules.

10.4 Related amounts. Trade3ra may offset or recover a duplicate payment, reversed payment, fraudulent payout, or amount finally determined to be owed under this Agreement. It will not confiscate unrelated approved amounts without a documented contractual or legal basis.

11. Technical errors, disputes, and corrections

11.1 Report promptly. You should report a suspected chart, order, fill, balance, drawdown, pass, or payout error through the stated support channel as soon as reasonably possible and include the account, session, time, screenshots, and order details available to you.

11.2 Investigation. Trade3ra will compare the report against server-side records, the assigned historical sequence and transformation, order-engine logic, and rule version. Customer screenshots are supporting evidence but are not the only evidence.

11.3 Correction. If a manifest platform error materially harmed the account, Trade3ra may restore the affected state, remove or reprice the affected simulated Trade, provide a no-cost reset or replacement, or refund the affected service. If a manifest error created false profit or payout eligibility, Trade3ra may correct only the affected result and explain the correction.

11.4 Outages. Trade3ra may pause affected sessions during maintenance, outage, vendor failure, cyber incident, or force majeure. It will not count a documented platform-caused interruption as a rule violation where a reasonable restoration is technically available.

12. Fees, refunds, withdrawal rights, and subscriptions

12.1 Clear total price

Before payment, the checkout must display the final charge, currency, taxes, any activation or reset fee, whether the charge recurs, the billing interval, and how to cancel. Optional charges require separate affirmative consent and may not be preselected.

12.2 Immediate digital access

Trade3ra normally begins supplying digital access immediately after payment. Where applicable law provides a withdrawal period, checkout will ask separately for your express request that performance begin immediately and your acknowledgment that, to the extent permitted by law, the withdrawal right may end once digital supply begins or the service is fully performed. If applicable law does not permit that result, the mandatory right controls.

12.3 SIM-account refunds

Unless mandatory law or the accepted Product Rule Summary provides more favorable rights, a one-time SIM account or reset fee is refundable before activation. After the account has been activated and historical data, a session, or account functionality has been supplied at your express request, the fee is generally non-refundable. This does not limit refunds for duplicate charges, Trade3ra's failure to deliver the purchased service, a valid statutory remedy, or a refund Trade3ra expressly promises.

12.4 Replay subscriptions

A paid Replay subscription renews only if the customer separately and expressly accepts the recurring price and interval. The customer may cancel through a simple online method that is at least as accessible as enrollment. Cancellation stops future renewal and access continues through the paid term unless a refund or immediate termination is required by law. Trade3ra will not convert free sessions into a paid subscription without express consent.

12.5 Promotions and resets

A discount code, complimentary account, free reset, credit, or certificate has no cash value, is non-transferable, and may be subject to clear promotion-specific limits. Promotion terms cannot retroactively reduce an earned payout under an already accepted account configuration.

12.6 Chargebacks

You should contact support before initiating a payment dispute so Trade3ra can investigate. A chargeback does not waive either party's legal rights. Trade3ra may suspend services associated with a reversed payment while the dispute is pending, but will not penalize a good-faith exercise of a statutory payment right.

13. Changes to the Services and rules

13.1 Active-account protection. Trade3ra will not retroactively increase the target, reduce the drawdown, increase the buffer, reduce a payout percentage, add a minimum trading-day rule, or otherwise materially disadvantage an active SIM account unless required by law and accompanied by a lawful remedy.

13.2 Future purchases. Trade3ra may change products, prices, rules, instruments, or features for future purchases. The new version applies only after it is published and affirmatively accepted for a new purchase, renewal, reset, or materially changed service.

13.3 Legal or security changes. Trade3ra may make a narrowly tailored immediate change when required by law, a regulator, a payment provider, a data licensor, or an urgent security threat. If the change materially removes paid value, Trade3ra will provide notice and an appropriate continuation, replacement, credit, or refund where required.

14. Intellectual property and permitted use

Trade3ra and its licensors own the software, interface, branding, rule presentation, protected historical-data presentation, transformation methods, and related content. Subject to this Agreement, Trade3ra grants you a personal, limited, revocable, non-exclusive, non-transferable license to use the Services for individual practice and participation during the applicable term.

You may keep ordinary screenshots and journal records for personal review and truthful social posting, provided you do not disclose confidential historical mappings, bulk market data, security methods, another person's information, or misleading claims that simulated activity was live. You may not sell, sublicense, clone, scrape, frame, or commercially exploit the Services or market data without written permission.

15. Privacy, monitoring, and communications

15.1 Privacy Policy. The separate Privacy Policy must identify the data controller, data categories, purposes and legal bases, processors and payment/KYC providers, international transfers, retention periods or criteria, security measures, user rights, complaint route, and privacy contact. This Agreement does not replace that policy.

15.2 Operational monitoring. To operate and protect the challenge, Trade3ra may process identity, contact, location, device, access, payment-token, KYC, trading, session, order, journal, support, affiliate, and payout information as described in the Privacy Policy. Monitoring must be proportionate and not used to secretly change a trader's market path.

15.3 Optional marketing. Consent to optional marketing, publication of a certificate, testimonial, payout story, name, image, or social handle must be separate from acceptance of this Agreement. Refusing marketing consent does not affect account or payout eligibility.

15.4 Service messages. You consent to necessary electronic receipts, security alerts, rule-status messages, payout communications, and legal notices. These are not optional marketing messages.

16. Suspension and termination

You may stop using the Services at any time and cancel any recurring subscription as provided in Section 12. Trade3ra may suspend or terminate access for a material breach, prohibited conduct, nonpayment, unlawful use, verification failure, security threat, or legal restriction. Except where urgent action is necessary, Trade3ra will give reasonable notice and an opportunity to cure a curable issue.

Termination ends the license to use the Services. Provisions concerning payment, approved payout obligations, records, privacy, intellectual property, dispute resolution, liability, and terms that by nature should survive will continue. A termination does not erase mandatory refund or consumer rights.

17. Disclaimers and limitation of liability

17.1 No performance promise. Trade3ra does not promise that you will pass, receive a payout, improve live trading, earn income, obtain employment, or achieve any result shown by another trader. Testimonials and certificates describe individual simulated outcomes and may not be typical.

17.2 Service disclaimer. To the maximum extent permitted by law, the Services are provided as available, without implied warranties beyond those that cannot lawfully be excluded. Trade3ra does not warrant uninterrupted operation, perfect market data, or identical results across devices or between simulation and live trading.

17.3 Excluded damages. To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, punitive, or consequential damages, or for lost live-market opportunity or hypothetical trading profit, arising from the Services.

17.4 Liability cap. To the maximum extent permitted by law, Trade3ra's aggregate contractual liability for a claim is limited to the greater of (a) the fees the customer paid for the directly affected product during the 12 months before the event, or (b) any minimum remedy required by applicable law.

17.5 Carve-outs. Nothing limits liability that cannot legally be limited, including liability for fraud, intentional misconduct, death or personal injury caused by legally actionable fault, data-protection liability that cannot be capped, or a valid obligation to pay an already approved payout.

17.6 User responsibility. You are responsible for your devices, internet access, account security, tax obligations, lawful use, and any decision to engage in separate live trading. Trade3ra is not liable for live trades you choose to place elsewhere.

18. Indemnity

To the extent permitted by law, you will indemnify Trade3ra against third-party claims and direct losses arising from your intentional unlawful conduct, infringement, account sharing, fraudulent documents, payment fraud, unauthorized data extraction, or material breach of Section 9. This does not require you to indemnify Trade3ra for its own negligence, breach, unlawful conduct, or matters for which consumer law forbids indemnity.

19. Complaints, governing law, and disputes

19.1 Customer complaint. Send a complaint through the Support page in your Trade3ra account or through the contact method published on trade3ra.com, and include the account and transaction details. Trade3ra will acknowledge it, respond within the period required by applicable law, maintain a complaint record, and provide escalation information.

19.2 Informal resolution. Before filing a non-urgent claim, each party will give the other written notice and 30 days to attempt a good-faith resolution. This does not suspend a statutory limitation period or prevent urgent injunctive, consumer-authority, privacy-authority, or payment remedies.

19.3 Governing law. This Agreement is governed by the laws of the Republic of Kosovo, without depriving a consumer of mandatory protection available under the law of the consumer's habitual residence.

19.4 Courts. Subject to mandatory consumer jurisdiction rules, courts of competent jurisdiction in Prishtina, Republic of Kosovo, have non-exclusive jurisdiction. This Agreement does not require mandatory arbitration and does not include a class-action waiver.

20. General terms

20.1 Entire agreement. The contract documents listed in Section 1.3 are the entire agreement for the purchase and replace earlier statements on the same subject. Fraudulent or legally actionable misrepresentations are not excused by this clause.

20.2 Severability. If a term is invalid or unenforceable, it will be limited only as necessary and the remainder continues, unless the contract cannot fairly operate without it.

20.3 No waiver. A delay in enforcing a right is not a waiver. A waiver must be clear and applies only to the stated instance.

20.4 Assignment. You may not transfer an account or payout claim without written permission. Trade3ra may assign this Agreement as part of a legitimate merger, reorganization, or sale only if the successor assumes Trade3ra's obligations and the assignment does not materially reduce mandatory customer rights.

20.5 Force majeure. Neither party is liable for delay caused by events beyond reasonable control, except that force majeure does not erase a refund legally owed, an approved payout obligation, or duties that can still reasonably be performed.

20.6 Language. The checkout must identify the controlling language and provide any translation required by law. If a translation conflicts, the controlling-language clause applies only to the extent lawful and ambiguities in consumer terms are resolved as required by applicable law.

20.7 Notices. Trade3ra may send legal notices to the verified account email and post them in the dashboard. A material change requiring new consent is not accepted merely because it was posted.

All Trade3ra trading shown is simulated using historical market data. No live orders or customer trading capital are involved. Individual results are not typical, and simulated performance does not predict live trading results. Cash payouts, where offered, are conditional Trade3ra rewards subject to public rules, verification, and applicable law.

Schedule E - Definitions

Account Metrics. The server-calculated SIM balance, equity if applicable, profit, loss, drawdown threshold, consistency ratio, buffer, and payout-period data.

Buffer. The non-withdrawable simulated profit amount that must be reached before profit above it can support a payout request.

Gross Request. The simulated amount approved for balance deduction before application of the 90/10 split.

Historical Market Data. A past market-data sequence from a source or licensor, which may be normalized or otherwise transformed for challenge integrity.

Manifest Error. A reproducible and objectively verifiable data, calculation, order-engine, or software malfunction, not ordinary simulation-versus-live difference.

Performance Reward or Payout. Cash paid by Trade3ra after approval under the SIM Performance rules; not a withdrawal of customer funds or live trading profits.

Product Rule Summary. The versioned, account-specific terms and numbers shown immediately before payment and stored with the acceptance record.

Rule Center. Trade3ra's public rules page, identified by version and effective date.

SIM. Simulated; involving no actual market order, position, asset, account capital, or investment custody.

Trade. One continuous net simulated position or substantially related exposure, including entries, adds, reductions, and exits treated together for risk-rule purposes.

Electronic acceptance record

When you accept this Agreement, Trade3ra records and makes available a durable electronic record containing:

  • Verified customer name and account ID
  • Agreement and Rule Center versions
  • Product configuration ID and snapshot hash
  • Acceptance time in UTC and the customer's local time
  • Electronic acceptance event ID

This record forms part of the contract for the applicable purchase and remains available in the customer's account records.
